Introduction

These Terms of Service ("Terms", "Agreement") govern your access to and use of octomy.org ("Website", "Service") operated by Korall Engineering™ ("we", "us", "our"), a project based in Bergen, Norway.

Termination

Applicable law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Dispute resolution

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bergen, Norway. You consent to the personal jurisdiction of such courts and waive any objection as to inconvenient forum.

We encourage you to contact us first to seek resolution of any dispute informally before initiating formal legal proceedings.

Limitation of liability

To the maximum extent permitted by applicable law, Korall Engineering™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service;
• Unauthorized access, use, or alteration of your transmissions or content.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied.

Indemnification

You agree to defend, indemnify, and hold harmless Korall Engineering™ and its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Changes to terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice by posting a prominent notice on our Website before any new terms take effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
